So … What Do We Do with All the Guns? … and will the Executor (or attorney) be liable?
Your clients come in for estate planning and you interview them regarding their family, their assets and their testamentary wishes. You prepare their documents, review the drafts with them and schedule an appointment for signing the documents. When they’ve completed the documents and are getting up to leave, they ask “so what do we do with all the guns?” Or you interview the named Executor on an Estate, sign an agreement to assist with the Estate administration and start the estate administration process. You review assets of the Decedent and discuss strategy and timelines with the Executor. The Executor is sworn in, you close out the bank and brokerage accounts, and start to clean out the house for sale… and you find a gun safe loaded with rifles and other long guns in the basement, and then you find an assortment of handguns located throughout the house… what next?
