Иностранный элемент в международном частном праве<br>(часть 1)

The article analyses the one of the key notions of private international law which is the foreign element. The triad of the foreign elements: the foreign subject, the foreign object, the foreign juridical fact is qualified as corresponding to the premises of the legal relations in the general theory of law. Further, the actual case law is analysed in which the controversial issues of the foreign element are dealt with. Moreover, the theory of the objective and subjections situations with the foreign element is discussed. At last is raised the question of the hierarchy of the foreign elements in the case of their collision.
