Overview This practical CLE program provides attorneys with a comprehensive framework for advising clients on both routine and crisis-driven end-of-life planning. The course begins with an overview of essential planning tools, including financial and health care powers of attorney, living wills, trusts, last wills and testaments, and guardianships, with a focus on their real-world application and interplay. Building on this foundation, the program addresses one of the most challenging aspects of practice: responding to urgent calls from clients or their families when a crisis arises. Faculty will walk through how each planning document functions under pressure, offering guidance on immediate decision-making, managing client and family expectations, and navigating time-sensitive legal and practical constraints. The course also explores common ethical pitfalls that can arise in both routine planning and emergency situations. Attendees will gain insight into best practices for identifying the client, working with individuals with diminished capacity, maintaining confidentiality within complex family dynamics, and responding appropriately to suspected abuse. The program will also address the duty of competence and how to avoid conduct that could give rise to ethical concerns. Designed for attorneys who advise individuals and families on end-of-life matters, this session delivers both foundational knowledge and actionable strategies to enhance client service, mitigate risk, and confidently handle high-stakes situations.
